Wholesale Terms & Conditions
Retailers must agree to our Terms & Conditions and we reserve the right to discontinue sales to stores who fail to comply. Please note, terms and conditions are subject to change at any time.
1. ORDERING & PAYMENT
1.1 Minimum Order Quantity
At JCMA The Label, we want to encourage you to stock our full range, we require a minimum quantity of five sizes per product and have a minimum spend of one size run for your first order of any season's collection.
1.2 Pre-Sales
Stockists that do pre-sales to customers on their website must have ordered the product on JCMA The Label website or contact info@jcmathelabel.com and paid the invoice in full prior to pre-sale. If a stockist orders a product from JCMA The Label that they have pre-sold on their website, and arrives at JCMA with a defect or size issue, we are unable to send out that product to the stockist. Pre-sales are done at the stockists' risk. We do not take responsibility for pre-sales.
1.3 Payment
When purchasing stock, payment must be upfront via either Direct Bank Transfer, Direct Debit or Credit Card. There are no surcharges for payment by direct debit or credit card unless the customer has an existing outstanding balance that has not yet been paid. Once payment has been received, we will distribute the stock to you. Please allow 1-5 working days for the process of payments. If you require the stock immediately, please email us at info@jcmathelabel.com and we will endeavour to accommodate a quicker turnaround time. All shipment involved must now be paid prior to shipment or packages will not be shipped. A stockist of JCMA The Label merchandise is responsible for insurance in case of theft and damage. Any outstanding payment will incur an administration fee of $20 and all overdue payments will incur a 10% additional fee; both with an additional wholesale payment surcharge included.
All stock must be paid in full upfront via direct debit or via credit card, stock will not be shipped until funds have cleared.
2. SHIPPING
Shipping costs depend on your location and the weight of the packages. Shipping will
be charged on checkout. You will be invoiced accordingly for shipping if required.
If stock is damaged in transit this is the responsibility of the shipping company, JCMA The Label takes no responsibility for shipping once it has left our premises. We encourage you to add additional insurance and tracking over such risks. If you, the retailer, engage your own courier service to ship the product then it is your responsibility to seek compensation for any damaged goods.
3. BACK ORDERS
On the odd occasion that a product is out of stock or we don’t have the quantity you have ordered available and we are unable to fulfil your whole order, we will notify you.
If directed, we will proceed to ship all available items from your order and once the other items are back in stock, we will ship them out immediately, at our cost. Alternatively, we can offer an agreeable alternative item, or credit note if necessary.
4. EXCLUSIVITY
We offer exclusivity of JCMA The Label products in one geographical area. Therefore, we strive to coordinate a non-competitive environment amongst our customers by selling to customers that are of reasonable distance from each other without affecting our stockists' sales.
5. PRODUCT IMAGE
If you are an online retailer, we are happy to supply you with our product or lifestyle images. Please email us to request the ones you require.
Images must be used in their supplied state to maintain quality. No cropping, editing, filters or additional compression is to be applied.
All images are subject to copyright and must only be used to market JCMA The Label, they cannot be used as banner images on your website or social media unless requested and approved by JCMA The Label.
6. PRODUCT COLOUR
Whilst every effort has been made to ensure our products are displayed accurately on screen, some computer monitors may display colours incorrectly and the artwork may vary slightly from the colours you see on your monitor.
7. INTELLECTUAL PROPERTY
All garments under JCMA The Label and MODA by JCMA The Label are exclusively designed by our own in-house designers. We reserve the right to refuse a stockist’s request in relation to adjustments of intellectual property. We are happy for stockists to change swing tags, however, the change of JCMA The Label garment labels will not be accepted.
8. MISCONDUCT
JCMA The Label has the right to refuse a stockist or cancel a stockist order, if a stockist is misleading in any way or form. This includes but is not limited to unduly payments, frequent inappropriate request of cancellation, returns or exchanges, misuse of product image or any changes identified relating to intellectual property. We may do this at any time if our brand is being represented in the wrong way.
9. RETURNS & EXCHANGES
Unfortunately, we cannot cancel an order once it has been processed. If you would like to make adjustments to your order, please contact sales@jcmathelabel.com within 24 hours and JCMA The Label will then check if the order has left the warehouse. No possible changes or cancellations will be accepted after this.
JCMA The Label strictly does not accept change of mind as a reason for cancellation, returns or exchange of wholesale purchases. Damaged or faulty items are only accepted if they are deemed a manufacturing fault.
If the fault is considered to have been caused under the client’s care, JCMA The Label reserves the right to refuse the faulty item for cancellation, returns or exchange.
If your order, or part thereof, arrives damaged please notify us within 5 business days of receipt through email at sales@jcmathelabel.com. Upon reviewing the email, JCMA The Label will inform you of the address to return it to if the faulty items have been accepted and approved as a manufacturing fault. You will then be asked to return the damaged items for a replacement or receive a credit note for full priced items. Please
note that this applies to full price items only; there are strictly no cancellations, returns or exchanges for sale items.
The Goods must be returned with all packaging as close as possible in their original condition, securely wrapped, with original swing tags and labels attached.
We are unable to accept returns or exchanges for unsold stock.
